A Will is a legal document that specifies your wishes regarding the distribution of your assets. If you do not have a Will, your estate may not be distributed according to your wishes and your family could face unnecessary expense, time and stress in settling your affairs.
A Power of Attorney is a legal document that permits someone to act on your behalf as an agent. If you do not have a Power of Attorney and become incapacitated, a loved one may have to petition a court to have someone named as a conservator for that purpose. Such court proceedings are public and can add unnecessary costs and delays in managing your affairs.
A Health Care Proxy is a legal document that names someone to make and communicate health care decisions if you are incapable of making or communicating such decision for yourself. As is the case with not having a Power of Attorney, if you do not have a Health Care Proxy and become incapacitated, a court could name a guardian to make health care decisions for you.
